Mr. Obama? Don t forget the cyberwar threat

A 96-page report released Monday by the Center for Strategic and International Studies paints a gloomy picture of where America stands in the matter of infowar. Hint: Stands may be too optimistic a verb.

The report is blunt : We re in trouble, our laws are out of date, we need leadership from the White House, and money public and private must be applied to the problem. Only a plan that respects privacy and civil liberties will do, and only a comprehensive policy covering both domestic and international situations will work.

It s hard to turn the course of government on a DIME, but that strategy -- combining Diplomatic, Intelligence, Military, and Economic efforts -- is the commission s recommendation. Law enforcement s mentioned too, but DIMELE just doesn t have the same change-redolent jingle, does it?

Cyberwar isn t something out of Strangelove. We ve been drilling for it for years -- and some observers would suggest that we ve been engaging in it, too. Over just the past year, the Departments of Defense, State, Homeland Security, and Commerce, along with NASA, and the National Defense University have all been targeted by hack attacks from outside our borders, and those are the ones we know about. As recently as last week, the Department of Defense was forced to scramble in response to a old-but-tweaked worm that made its way onto both NIPRNet and SIPRNet through, allegedly, USB drives left scattered in parking lots.

The report calls for a strong statement from the White House that our cyber-infrastructure is a vital asset, and that we ll protect the asset with all instruments of national power to assure our security, safety, prosperity, and ability to deliver critical services.

In fact, it s hard to imagine language much stronger landing on the desk of an incoming president in, well, any economy but the current one.

The United States must treat cybersecurity as one of the most important national security challenges it faces, the report says. Calling the previous administration s Comprehensive National Cybersecurity Initiative good but not sufficient, it describes cybersecurity as a strategic issue on par with weapons of mass destruction and global jihad.

The report also calls for a new National Office for Cyberspace, to work with the National Security Council NSC -- and says that it needs to be based in the Executive Office of the President. In addition, the report suggests that there should be established a Cybersecurity Directorate in the NSC that absorbs the functions of the Homeland Security Council HSC . The HSC was formed in the aftermath of 9 11 and has been heretofore separate from the NSC. Existing agencies would keep their current operational abilities; for instance, DHS would retain control of US-CERT .

Privacy watchdogs will be interested to see the report s thinking on identity management. The report advocates for the use of strong identity authentication for critical cyber-infrastructures, and fast -- the President should have a progress report within six months. But there s at least some serious thought about how to keep online entities, particularly businesses, from abusing new standards for credentials. The FTC, in its GLBA-enforcement aspect, would be in charge of riding herd on that.

The government s own standards for maintaining security also need an overhaul. The report calls for a rewrite of the Federal Information Security Management Act FISMA to introduce performance-based security measurements, which ought to unnerve those charged with passing those FISMA audits . And civilian agencies and national security programs are to move onto an equal legal footing when it comes to tech standards; risk-based standards covering all federal IT systems are to be developed.

The CSIS Commission on Cybersecurity for the 44th Presidency has been working on the report since August 2007; its work included dozens of meetings and briefings with government and private-sector officials as well as multiple congressional hearings and briefings. The commission s chairs were Rep. Jim Langevin D - R.I. , Rep. Michael McCaul R - Tex. , Air Force Lt. Gen. Harry Raduege ret., currently with Deloitte , and Microsoft Corp. VP for Trustworthy Computing Scott Charney. CSIS is bipartisan and nonprofit.

What YouTube s new 16:9 aspect ratio means for users

There are some significant and some insignificant aspects of YouTube s adjusted main screen. The service s embrace of widescreen today, we discovered, doesn t change much besides what you see on the surface.

A number of videos with 16:9 widescreen ratio have already been featured on YouTube, and long-time users with widescreen monitors know that YouTube already supported that ratio whenever a video is expanded to full screen mode. Movie trailers are among the content that YouTube has supported in their native aspect ratios.

Until yesterday, the size of that content on YouTube s main player page has been letterboxed to fit within a 4:3 box -- one with a CRT s aspect ratio. Now, YouTube is reversing which videos it chooses to letterbox, by presenting its main page with a bigger 16:9 display. From this point on in the main page, videos in the 4:3 ratio are displayed with black borders along the left and right sides, though without shrinking them any smaller than they had been displayed before. But uploaded videos with 16:9 aspect ratio will be displayed within a larger area.

That s on the main page, at least for now, we discovered. For users with their own private channels, we found that videos remain featured in the 4:3 aspect ratio. Meanwhile, some of the commercial channels on YouTube had already begun implementing widescreen viewing options over a month ago.

The methodology for embedding videos within other pages also remains the same. This morning, we noticed the default values that YouTube provides when writing its automatic HTML code remain width 425 height 344 , even for videos that are natively widescreen. Coders may, of course, change these default values to suit their own pages.

What YouTube s switch cannot change, unfortunately, is the situation where widescreen videos were changed to 4:3 aspect ratio prior to their having been uploaded...in order that they could fit within the 4:3 viewer YouTube originally provided by default. Today, we noticed that such reworked videos appear with black borders all around them, as YouTube now adds letterboxing on the wings, if you will, in addition to those along the top and bottom that were already present.

YouTube s behavior when expanding videos to full screen does not appear to have changed; the system still expands the video to fit the size of your monitor as best it can.

The school wanted to provide reliable access for its 670 students throughout the school, so subject teachers can use Internet resources in any lesson, without having to move the class into a dedicated IT suite. The wireless LAN had to be reliable, and able to support up to 64 laptops at once.

Whole classes of students can access the network at the same time without interruption, said Paul Clark, Strategy leader for ICT at St Bernard s. This network gives more flexible access to our ICT facility, and will allow us to get laptops into all curriculum areas.

UK based Networks by Wireless won a competitive tender, convincing St Bernard s School that wireless LAN equipment from Meru Networks would succeed where other equipment had failed, and provide a network the school could trust.

The school has a new wired LAN, installed this year, and each classroom has a networked PC and an interactive whiteboard. Paul wanted to go further, and give each student network access, but was not convinced wireless LANs were up to the job.

We had tried a wireless LAN before, with a few access points in a small area, but we took it out a year ago, because it was unreliable, said Paul. After this experience, Paul was sceptical that any wireless LAN could meet his school s requirements: We had decided to move away from wireless and get things cabled in.

The demands of pupil access changed that. When a large number of laptops, wheeled to the classroom in a trolley, are handed to students at the beginning of a lesson, wired connections are simply impractical. So the school issued an invitation to network companies, to tender for a reliable wireless LAN that would allow instant access anywhere in the school.

The winner of that tender, Meru s fourth generation single-channel wireless LAN, avoids the unreliability and interference issues common place with legacy wireless LANs. Access points are placed on a single radio channel, eliminating the need for costly channel planning. Legislation would force all new US radios to include digital HD

More digital radios, especially those installed with new automobiles, include the capability to pick up digital HD Radio broadcasts over the air. But should the government mandate that satellite radio sets include HD Radio capability?

Demonstrating that there actually were at least a few spare minutes for Congress after all, during the debate over the financial bailout plan, House Telecommunications Subcommittee Chairman Ed Markey D - Mass. introduced a bipartisan bill that will require all future AM FM radios or satellite radio receivers made or sold in the US to also receive digital HD broadcasts.

HD Radio, though not necessarily high-definition, refers to digital broadcasts in the sidebands that many US radio stations utilize to provide extra channels of programming. The effect is similar to new supplemental digital television channels, which enable alternate programs that can be picked up over the air. Currently, there s no requirement that HD Radio be built into new radio equipment, though more and more sets -- particularly in automobiles -- is including it.

The big change, therefore, would be for Sirius XM Satellite Radio, whose plans for now are to continue producing some radios for Sirius subscribers and other radios for XM subscribers. This bill wouldn t force satellite functionality to be interchangeable, though it would force the nation s sole satellite radio provider to open up alternate channels for commercial digital broadcast radio.

The language of the bill is very simple: It would amend the Communications Act of 1934 to require that apparatus shipped in interstate commerce or manufactured in the United States that is designed to receive signals broadcast in both the satellite digital audio radio service and the terrestrial AM or FM radio broadcast service be equipped with technology that is capable of receiving and playing digital radio signals as transmitted by terrestrial AM or FM stations.

In a statement over the weekend, Rep. Markey said his objective was to ensure that future radios are still capable of providing listeners with local news.

Millions of Americans today rely on local broadcast radio for news, public safety bulletins, sports, weather, traffic and other information, Markey stated. As the broadcast radio industry migrates to digital broadcasting technology, this legislation will ensure that consumers are able to readily receive free service through consumer electronics systems that are otherwise receiving satellite digital audio radio and traditional AM or FM stations. Further, the recent merger of the only two satellite radio providers, XM and Sirius satellite radio, has underscored the importance of ensuring consumer access to a diversity of sources for digital radio content, in particular content originating in their local communities. My bill therefore simultaneously seeks to address the long-term competitive health of local radio while ensuring that their local, digital services are readily received by radio consumers.

As anticipated, the National Association of Broadcasters voiced its support for the bill. In a statement this afternoon, NAB President and CEO David K. Rehr said, In addition to providing 235 million weekly listeners with entertainment and music programming, free local radio stations have a long tradition of serving as a lifeline during times of crisis. This legislation will extend and enhance these services as radio stations embrace our digital future.

Spokespersons for Sirius XM declined a direct comment on the matter, but instead pointed us to an article elsewhere that cites the fact that the Federal Communications Commission continues to study the possible impact of any HD Radio requirement on competition.

Last month, the FCC opened up a 90-day comment period for the public to comment on whether it believes competition may be affected by the onset of more federal regulation. That comment period remains open, even though Markey s bill was introduced right in the middle of it.

As an initial matter, we seek comment on the extent to which the market is already making multi-functional radio receivers available to the public that include two or more of the following capabilities: SDARS, HD Radio, iPod MP3, Internet, or any other technologies capable of providing audio entertainment services, reads the FCC s August 25 Notice of Inquiry PDF available here . How many of each type of multi-functional radio receivers are available today, including factory-installed receivers in automobiles and receivers later installed in vehicles in the so-called aftermarket? How many multi-functional radio receivers are expected to be available in the near future without a Commission requirement? To the extent that multi-functional radio receivers are not available today and are not expected to be available in the near term, is this because of a lack of consumer demand for such receivers or some other reason? How does any lack of multifunctional radio receivers impact competition among SDARS, HD Radio, iPod MP3, Internet, or any other technologies capable of providing audio entertainment services?

After the FCC issued an order approving the transfer of assets from XM to Sirius, Commissioner Jonathan Adelstein issued a statement dissenting from that order, which included a warning about the HD Radio issue.

While some proposed that we require HD radio technology be incorporated into all new satellite receiver models capable of receiving analog terrestrial radio, I proposed we require it only in subsidized models. That way, if there were truly an open market for devices, as an independent process for certification would have ensured, the market would determine whether to integrate HD radio into the devices, Adelstein wrote PDF available here . Where the merged company sought to alter market dynamics through subsidies or other mechanisms, it would be prevented from discriminating against competing HD radio technology. Instead, the Order allows the merged company to avoid subsidizing models that include HD radio, thus using their market power to thwart the very competition the Applicants XM and Sirius cited as justifying the merger.

Lawsuit around Apple s first iPhone dismissed from federal court

Although the jury and judge might still be out on a later class action suit targeting Apple s newer iPhone 3G, a US judge has now ruled that Apple did not engage in deceptive practices concerning the original iPhone.

With a class action action around Apple s newer iPhone 3G still pending, a US judge has now thrown out a different lawsuit that had charged Apple with engaging in deception around batteries in the original iPhone.

While a suit filed this past August claimed that the iPhone 3G doesn t live up to promises of being twice as fast for half the price, the earlier suit accused Apple of committing consumer fraud by allegedly failing to tell customers about the real life span of the first iPhone s batteries.

Filed by Jose Trujillo in July, 2007 in Illinois State Court, the battery lawsuit cited the original iPhone batteries as well as the 86 replacement cost.

After the case was moved to federal court, a US district judge in Chicago granted Apple s request for dismissal late last week.

Apple disclosed on the outside of the iPhone package that the battery has limited recharge cycles and may eventually need to be replaced by Apple service provider, the judge wrote in his opinion. Under the circumstances, no reasonable jury could find that deception occurred.

The class-action lawsuit regarding the more recent iPhone 3G -- filed in US District Court in southern Alabama by Jessica Alena Smith -- charges that the 3G is defective, and that Smith experienced an Internet connection that was slower than expected and advertised.

In or around the Summer of 2008, Apple began marketing and put out for consumption the Defective iPhone 3G, according to a copy of the iPhone 3G complaint obtained by BetaNews. The release for consumption of the Defective iPhone 3G was preceded and followed by an aggressive marketing campaign, which included radio, television, and paper advertisements. One could barely turn on the television without hearing that the new iPhone 3G was twice as fast for half the price.

Meanwhile, Apple has previously settled two separate lawsuits in the US and Canada alleging that batteries in the first three generations of iPods were faulty.

Leaked HTC 'G1' specifications reach critical mass

How long could an "open" system effectively been kept in the dark? The facts are stacking up, and HTC's "Dream" G1 Android phone has all but been completely revealed.

AndroidGuys, a blog dedicated to what else but Google's Android and its related handsets, has published a design drawing and compiled a list of specs for the highly anticipated HTC/T-Mobile/Google handset.



On Monday, FCC filings for the handset were made public, showing the G1's size (115mm x 55mm) and communications protocols (Quad-band GSM, UMTS, HSDPA, SUPL, 802.11b/g, GPS, Bluetooth 2.0). Earlier in the month, a video purporting to show the HTC Dream was leaked. One would think there were few surprises left for the device.

Yet there was one such surprise yesterday, if not for the "Dream" specifically then for the Android OS it will run on: the intentional omission of Bluetooth's API from the latest 0.9 version of the Android SDK. As BetaNews learned , Android couldn't pass on the latest Bluetooth API openly without exposing trade secrets.

To ensure that no stone has been left unturned, third-party Android developers have compiled a list detailing everything from the on-board apps to the "kicktail" design of the device's trailing edge.

While these must still be classified as "rumor," albeit with some pretty convincing-looking diagrams, the specs are nonetheless interesting.

The G1 is expected to have: a 528 MHz Qualcomm 7201 Processor, 64 MB RAM, 128 MB ROM, 1 GB microSD, 3.1 megapixel flashless Camera, 480 x 320 3.17" HVGA display, speakerphone, Google Calendar Sync, a dedicated YouTube player, downloadable Android Marketplace apps, and Google Maps supporting Street View.

The "arc slider"-style phone may bear a resemblance to the newest Sidekicks (manufacturer by Sharp), although it will be the first ever to be emblazoned with the "With Google" logo.

Electronic Arts won't extend Take-Two deadline

NEW YORK - Video game publisher Electronic Arts Inc. is retracting its hostile bid for smaller rival Take-Two Interactive Software Inc., but a deal — and a friendly one at that — is likelier than ever.

Take-Two, best known for the popular "Grand Theft Auto" video game series, confirmed Monday it expects to sign a confidentiality agreement with EA to begin formal discussions about "strategic alternatives."

EA had said earlier it wouldn't extend the Monday night deadline for its $2 billion tender offer to buy Take-Two. The companies have been unable to agree on a price for the past six months.

Now, EA says that if it does buy Take-Two, it no longer believes it can combine the company in time for the holidays, when video game companies make most of their money. Because of this, EA said it needs to review assumptions made to support its offer price of $25.74 per share.

"They are both posturing," said Wedbush Morgan analyst Michael Pachter. "EA is saying `we want to pay less,' Take-Two is saying they want more. The important thing is that they are talking."

EA already has extended its deadline for the offer five times, mostly to let regulators continue their antitrust review. The company said it would let the offer expire at 11:59 p.m. EDT Monday, and added it "remains confident that antitrust issues will not prevent or delay a transaction." The Federal Trade Commission is scheduled to complete its review by Thursday.

On Monday, EA said it will entertain a financial presentation by Take-Two under confidentiality agreements. Take-Two's management said it plans to present EA with its three-year product release schedule, financial projections and other nonpublic information meant to support its claims of what the company is worth.

EA wants to buy Take-Two not just for the "Grand Theft Auto" franchise, the company's main source of revenue, but also for its sports business and critically acclaimed titles such as "BioShock," which is being made into a movie. Take-Two's sales for the most recent fiscal year, which ended in October, totaled $982 million. EA, meanwhile, reaped sales of $3.67 billion in the year ended March 31.

On Friday, EA Chief Executive John Riccitiello called Strauss Zelnick, chairman of Take-Two's board, to discuss the offer. Following further discussions over the weekend, EA agreed to hear Take-Two's presentation.

In a letter made public Monday, Zelnick said the company "has made significant strides since EA first expressed interest" in Take-Two. In a separate statement, Zelnick said his company's board remains "unwavering in its belief" that EA's offer price was too low.

Shares of New York-based Take-Two slid $1.09, or 4.4 percent, to $23.75. This is still well above $17.36, the stock's closing price on Feb. 22, the last trading day before EA announced its offer of $25.74 per share. This could signal that investors are confident a deal will go through, but the question is at what price, and when.

Pachter, for one, said if the companies' managements "are as smart as I think they are," this price will be somewhere between $26 and $27, and an agreement could happen this week. But if Take-Two decides to hold out for a higher price, like $30 or more, the analyst expects EA to go hostile again, and at a price closer to $20. This, Pachter noted, is less likely, given the "dearth of other bidders."

If a deal does happen, EA has said it would give Take-Two's creative teams — many of which have worked under a succession of CEOs over the past few years — a "stable management" that understands video games. Riccitiello took over at EA in April 2007 and has since reorganized the software publisher into a "city-state model," with four game divisions and distinct, independent development studios.

Still, EA has been under pressure from investors to improve its creativity and rely less on sequels of existing hits — something the Take-Two acquisition could help accomplish.

Zelnick took over as chairman of Take-Two after a March 2007 shareholder coup ousted most of the company's top executives and board members over poor results, accounting troubles and controversy surrounding violent and sexual content in games. Several former executives, including ex-Chairman and CEO Ryan A. Brant, pleaded guilty in 2007 to falsifying business records after a probe into backdated stock options.

Shares of Redwood City, Calif.-based EA fell 48 cents to $47.76.
